These Terms of Service ("Terms") govern your use of the SongAI website at https://songai.io ("Website") and the services provided by SongAI. By using our Website and services, you agree to these Terms.

1. Description of SongAI

SongAI is an AI-powered music and song generation platform. SongAI enables users to create original songs, music, and audio content using advanced artificial intelligence technology.

2. License to Generated Music

SongAI's AI models are designed for music and song generation. Your rights in the music, songs, and audio content you create through SongAI ("Generated Content") are governed by this section.

2.1 Free plan. Generated Content created on the free plan is licensed to you for personal, non-commercial evaluation only. You may not distribute, publish, monetize, or otherwise commercially exploit it, and you may not register it with any copyright office, performing rights organization, or content identification system, unless and until you hold a paid plan as described below.

2.2 Paid plans. Upon your purchase of credits or an active subscription, SongAI grants you a perpetual, worldwide, non-exclusive, transferable, royalty-free license to use, reproduce, modify, distribute, publicly perform, synchronize, create derivative works from, and commercially exploit the Generated Content you create during any paid period, with no attribution requirement and no revenue sharing.

2.3 Retroactive coverage. Upon your first purchase, all Generated Content previously created under your account on the free plan is automatically covered by the paid-plan license in Section 2.2, retroactive to its date of creation.

2.4 Survival. The paid-plan license is perpetual and survives the expiry or cancellation of your subscription in respect of all Generated Content created while your plan was active.

2.5 Restrictions. The license does not include the right to use Generated Content to train machine-learning models, or to redistribute Generated Content as a standalone music-licensing catalog. You remain responsible for ensuring your use complies with the policies of any third-party platform on which you distribute Generated Content.

2.6 No warranty of copyrightability. SongAI makes no representation that AI-generated music qualifies for copyright protection or registration in any jurisdiction. The availability and scope of such protection vary by jurisdiction and may depend on the degree of human authorship involved.

3. Pricing and Refunds

SongAI operates on a credit-based system for AI music generation. Different features consume different amounts of credits based on complexity. Pricing details can be found on our Website. All sales are final, and we do not offer refunds on purchased credits except as specified in our Refund Policy.

4. User Responsibilities

Users agree not to generate illegal, harmful, or inappropriate content using SongAI. We reserve the right to suspend accounts that violate our terms of service or content guidelines. Users are responsible for ensuring their generated content complies with applicable laws and regulations.

5. User Data and Privacy
